Consumers find themselves to be over-indebted when their total household income is less than the expenses and debt obligations each month. This also includes when a consumer cannot fulfill their monthly expenses in a timely fashion.
If a credit provider does not fully and effectively conduct an affordability assessment before granting credit to a consumer, or if the assessment find that the consumer cannot afford credit and it is still granted, the National Credit Act considers this to be reckless lending.
Unfortunately emergency loans, short term loans and payday loans do not apply under reckless lending.
